Terms of Service for Xưởng thêu 4.0

These Terms of Service (“Terms”) govern Your access to and use of Xưởng thêu 4.0 (the “Service”), an embroidery workshop management application operated by Xưởng thêu 4.0 (“We”, “Us”, “Our”), a sole proprietorship based in Vietnam.

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, do not use the Service.

1. Description of the Service

Xưởng thêu 4.0 is an internal business tool that helps embroidery workshop staff manage:

• Customer orders, order status, and embroidery production workflow
• Customer relationship records and communication history
• Shipping operations with Vietnamese carriers (GHTK, ViettelPost)
• Financial transactions and accounting records
• AI-assisted product design generation
• Optional: scheduling and publishing posts to Facebook Pages You administer, via the official Meta Graph API

The Service is intended exclusively for internal use by workshop staff and administrators. It is not a consumer product, not offered for resale, and not marketed to the general public.

2. Eligibility and Account

To use the Service, You must:

• Be at least 16 years old
• Be authorized by the workshop owner to access the Service
• Provide accurate account information and keep Your login credentials confidential

You are responsible for all activity that occurs under Your account. Notify Us immediately at quanghuy.dn8@gmail.com if You suspect Your account has been compromised.

3. Use of the Facebook Pages Integration

If You choose to connect a Facebook Page to the Service, the following additional rules apply:

3.1. Your representations

By connecting a Facebook Page, You represent and warrant that:

• You are an authorized administrator of the Page You are connecting
• You have the legal right to publish all content (text, images, videos) You submit through the Service to that Page
• You will not use the Service to publish content that violates Meta’s Community Standards, Platform Terms, or any applicable law

3.2. Prohibited content and behavior

You must NOT use the Facebook integration to:

• Send spam, repeated identical posts, or content designed to artificially inflate engagement
• Post content that is illegal, infringes third-party rights, contains hate speech, harassment, sexual content, or misleading health/financial claims
• Impersonate any person or organization
• Attempt to bypass rate limits, evade detection, or circumvent any Meta enforcement
• Sell, share, transfer, or resell Page Access Tokens received through the Service
• Use the Service in any way that would cause Us to violate Meta Platform Terms

We may suspend or terminate Your access to the Facebook integration (or the entire Service) immediately if We reasonably believe You have violated this Section.

3.3. Your control

You control what is published. The Service does not auto-generate or auto-publish content without an explicit action initiated by You (a manual “Post Now” or a “Schedule” You configure). You may disconnect a Facebook Page at any time from the Social Posting → Connections page, which immediately revokes the access token.

4. Acceptable Use

Whether or not You use the Facebook integration, You agree NOT to:

• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Probe, scan, or test the vulnerability of the Service without prior written permission
• Use automated scripts, scrapers, or bots to access the Service beyond the documented APIs
• Upload malware, viruses, or any code designed to disrupt or damage the Service
• Use the Service to violate Vietnamese law or the law of any jurisdiction applicable to You

5. Intellectual Property

• Our property: The Service software, design, brand, and documentation are owned by Us. You receive only a limited, non-exclusive, non-transferable, revocable right to use the Service.
• Your content: You retain all rights to the content You upload to the Service (customer data, product images, post content). You grant Us a limited license to store, process, and transmit that content solely for the purpose of operating the Service on Your behalf (including transmitting Your posts to Facebook when You instruct).
• AI-generated images: Product designs generated by the Service’s AI features are output to You; ownership rules follow the terms of the underlying AI model providers (Google Gemini, OpenRouter).

6. Third-Party Services

The Service integrates with third-party platforms operated by other companies:

• Meta Platforms, Inc. (Facebook Graph API) — governed by Meta Platform Terms and Facebook Terms of Service
• Google LLC (Gemini AI, Google Drive, Google Docs)
• GHTK, ViettelPost (shipping carriers)
• Supabase (data hosting)
• SePay (payment QR generation)

We are not responsible for the availability, behavior, or terms of these third-party services. Your use of them is governed by their respective terms.

7. Service Availability and Changes

We provide the Service on a best-effort basis without uptime guarantees. We may:

• Modify, suspend, or discontinue any feature at any time, with reasonable notice when feasible
• Perform scheduled or emergency maintenance
• Update these Terms — we will notify You by updating the “Last updated” date and, for material changes, by a notice within the Service

Continued use of the Service after changes constitutes Your acceptance of the updated Terms.

8. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Posts will be delivered to Facebook successfully on every attempt (Meta’s API may rate-limit, reject, or delay delivery for reasons outside Our control)
• AI-generated content will be accurate, suitable, or free of errors

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall We be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, customers, data, or goodwill, arising out of or related to Your use of the Service.

Our total cumulative liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount You paid Us for the Service in the 12 months preceding the claim, or (b) one hundred United States dollars (US$100).

This Section does not limit liability where such limitation is prohibited by applicable law.

10. Indemnification

You agree to indemnify and hold Us harmless from any claim, demand, loss, or damage (including reasonable legal fees) arising from:

• Your content uploaded to the Service
• Your use of the Facebook integration in violation of Meta’s terms
• Your violation of these Terms or any applicable law

11. Termination

You may stop using the Service at any time and request account deletion as described in Our Privacy Policy.

We may suspend or terminate Your access immediately, without prior notice, if:

• You materially breach these Terms
• We are required to do so by law
• Continued provision of the Service to You would expose Us to legal or platform-policy risk

Upon termination, sections that by their nature should survive (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will remain in effect.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict of laws principles. Any dispute arising out of or related to the Service or these Terms shall first be addressed by good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to the competent court in Vietnam.

13. Miscellaneous

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
• No waiver: Our failure to enforce any provision is not a waiver of that provision.
• Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between You and Us regarding the Service.
• Assignment: You may not assign Your rights under these Terms. We may assign Our rights to a successor in interest.
